Case Study: Allstate Tries to Deny, Delay, and Defend. Part #1

On the morning of February 14, 2001, 21-year-old Theresa Suddeth was on her way to class at the University of Washington. She was driving her 1983 Jeep vehicle on Brooklyn Avenue in the University District of Seattle. Theresa was traveling the posted speed limit of 30 mph.

Another driver then pulled out in front of her without yielding the right of way. There was a T-bone collision. Theresas vehicle struck the passenger side of the defendants vehicle. The defendant, 80 year-old Peter Combs*, claimed that he stopped before entering into the intersection, but that he could not see very far due to the sunshine. Theresas vehicle sustained $4,000 in damage. The defendants vehicle was totaled.

Theresa instinctively swerved to her right upon impact. She hit her head on the driver side door window. She was thrown forward and back again upon impact. The defendant was not injured. When police arrived on the scene, the defendant was cited for failing to yield the right of way.

Theresa was very shaken up while at the scene. She immediately called her mother and father. They both arrived on the scene to find that Theresa was crying and very upset.

Theresa refused medical attention at the scene. However, when her mother arrived and saw the golf-ball-sized lump on Theresas head, she insisted that Theresa see the familys doctor that afternoon. By the time Theresa saw her doctor a few hours later, she was also experiencing neck and back pain. The doctor diagnosed a neck and back strain and a contusion to the head. Theresa was advised to go home and ice her injuries and take Ibuprofen for pain.

Over the next 3 days Theresas complaints of pain grew progressively worse. She would later describe at trial as feeling that she was hit repeatedly by a baseball bat all over her body. She went to the Stevens Hospital emergency room with acute neck and low back pain. She was given a prescription for Vicodin and advised to rest and then follow up with her PCP in one week if her symptoms did not significantly improve.

Theresa never returned to see her PCP, despite the fact that her back pain persisted. At the suggestion of a friend, Theresa sought treatment from a chiropractor. She also received some massage. Unfortunately, this care actually made Theresas symptoms worse.

About four months after the collision, Theresas mother called the PCP for a referral to a back specialist because Theresas low back pain had not resolved. Theresa was advised to see an orthopedist doctor at Kruger Orthopedics clinic in Edmonds, Washington. The doctor saw Theresa just one time and prescribed 8 physical therapy sessions over the next 30 days. The doctor further instructed the physical therapist to develop a home exercise program for Theresa so she would not have to continue formal care. Theresa completed her last physical therapy session approximately 6 months after the date of the collision.

When Theresa finished her last physical therapy treatment, she stopped treatment. Theresa stopped treatment even though her low back pain was still present. Theresa did not receive treatment for the next two (2) years.

During this two-year hiatus from medical care, Theresa continued to perform her exercises and stretching routines as instructed by her physical therapist. She continued to experience daily low back pain. Theresas friends and family members all testified at trial that Theresa complained about her back pain constantly. Theresa testified at trial that over this two-year period she continued the exercise and stretching routine as taught by her physical therapist.

While Theresa was a full time student at the U.W., she was also employed in the shipping and receiving department of a small local production company. Her co-workers would later testify at trial that Theresa always needed help moving objects at work and that she needed to take frequent breaks.

During her two-year hiatus from medical care, Theresa maintained a full curriculum at the University of Washington. She graduated in four years with a degree in Anthropology. Theresas mother would later tell the jury that her only daughter was an exceptional student. Theresa graduated from the U.W. with a 3.75 grade point average.

At the repeated urging of her mother, father and other family members, Theresa decided to return to a physician in August 2003. Theresas mother referred her to another chiropractor who a lot of experience treating car accident victims with chronic back pain.

The chiropractor ordered an MRI scan of Theresas lumbar spine. The MRI revealed that Theresa had lower lumbar facet arthropathy (joint pathology) which was consistent with traumatically induced arthritis to the facet joints. The MRI also revealed a very mild disc protrusion at L5-S1.

Maximized Living Involves Good Healthcare

What exactly is “Maximized Living”? Maximize means to “make the most of” so, therefore, maximized living would entail making the most of your life.

Think about when you are sick. Is it easy to get even the simplest tasks accomplished? I’m not even talking about terminal illnesses. I’m talking about the common cold. Often, people are confined to the bed for days while the world passes them by as they wait for their body to recover.

Living well entails a variety of things, living well means making you a priority, and it means taking care of yourself so you can do the things that matter most. This is maximized living. You must surround yourself with people that are have the knowledge and expertise to help you live your life to the maximum.

Chiropractic has been around for over a century helping people live their lives to the maximum. You must have the best possible healthcare in order for you to feel your best. Chiropractic can do that for you.

Chiropractic focuses on the whole person and not just the symptoms. Chiropractic treats spinal subluxations that are related to dysfunction in the nervous system. Doctors of chiropractic will treat the subluxations through spinal manipulations – meaning they will literally move the spine into alignment. This manipulation is called an adjustment. Sometimes the adjustments can be alarming because of the sound of the “crack” during the procedure.

Chiropractors adjust their patients because it stimulates the body to heal itself. The body has an innate ability to rid itself of illness and disease as long as it is helped to be brought into balance. Instead of treating symptoms, doctors of chiropractic will remove the dysfunction that is interfering with the system. Secrets Revealed in the Wellness Industry

Dr. Deitch is the co-author of the best-selling book “Discover Wellness: How Staying Healthy Can Make You Rich.” Dr. Deitch is also the founder of Discover Wellness Center and the Chief Wellness Officer of the Master’s Circle and WellCall, Inc.

Kevin: So how does a natural health practitioner communicate with a doctor? How does that transpire?

Dr. Deitch: When you say doctor do you mean a medical doctor?

Kevin: Yes, a medical doctor.

Dr. Deitch: OK. I interchangeably use the term ‘doctor’ because I look at chiropractors as doctors. I look at us as what I think of as wellness doctors. Quite honestly there’s a whole misconception as to what a chiropractor really is. Many of these terms are poor terms to use these days. In fact I actually teach and coach chiropractors to stop saying, “Hi, I’m a chiropractor” because as soon as somebody hears you’re a chiropractor they already peg you as somebody who’s a neck and back pain specialist and don’t see you as anything beyond that because that’s the definition of it, according to our cultural consciousness.

So what I recommend people do is try to start explaining who they are and what they do by the benefits that it offers people, not by their training. So to say, “Hi, I’m a massage therapist,” pegs you as something that people perceive you to be, which is often times inaccurate. “I’m a nutritionist.” So people have perceptions or attachments as to what those labels really mean. They’re often inaccurate. I believe that if you were to start describing yourself more along the lines of… For example I’ll often introduce myself as a wellness doctor. I’m not just a bestselling author, I’m a wellness doctor. Typically the response I get from people is, “What’s that?” Which is exactly the response I want because then it allows me to get into the benefits of what it’s like to work with me not to get pegged into, “Oh, you’re one of those.”

I think we all have to create new definitions for all of that and respect and understand that for the most part medical doctors’ jobs are to treat disease. There’s a place for that. It’s important. There’s a growing continuum of people trying to learn where they are in that process but there are a lot of people who fit into that big, gray area where they may be outside of the “biometric norms” and have to make a decision. “Do I control my cholesterol through medication or do I start taking care of myself better and see what I can do to not have to go down that path?” “I’m overweight. Do I wait until I’m pre-diabetic or diabetic or do I try to do something so I don’t have to go down that route?” I believe that all of the lines are changing.

I think there are more medical doctors who see the devastating consequences of just putting people on drugs and are looking to figure out ways in which they can help more people on their lifestyle. Unfortunately they don’t get paid to do that. Insurance companies don’t reimburse for that. So it’s a very difficult business model for them to adopt. On the other hand, chiropractors have a wonderful opportunity because the reality is we are basically people who help people make better lifestyle choices without the use of drugs and surgery, which is really the essence of what’s required these days.

All of us need to get a better understanding, whether you’re a massage therapist, a naturopath, etc. We write about all of these in the chapter I mentioned to you earlier about creating your wellness routine. We really have a tremendous respect for all of us coming together to understand what role we play. You take any team – baseball team, football team, whatever it may be – people have different positions on the team and you can’t become a championship team unless you all understand how you help each other get here or win. It’s a job, no question. I’m not saying it’s easy. I’m not saying it’s going to happen overnight. But I am saying this is really the most exciting and powerful time that the wellness industry has ever seen and my hope, goal, vision is that if I’ve got something to say about it we will try to unite the personal training profession, for example, the massage therapy profession, the chiropractic profession, Pilates – pilates is tremendously powerful and influential these days. We all have a role in helping people understand that they need to take more responsibility for their healthcare. There’s no one right, perfect way for everyone all the time. We will do so much better for ourselves and for our patients and our communities if we can start working together and cooperating and understand that referring to each other is a great thing, but everybody participates versus everybody going through the scarcity and being divided as a profession.

Kevin: You said, “The five secrets revealed.” You’ve got to reveal one before you go. [Laughter]

Dr. Deitch: The first secret really is that there is a mindset of a wellness doctor that is different than a traditional doctor. I don’t mean traditional medical doctor but even in the “holistic healthcare field” there is a different mindset, one towards promoting health and wellbeing versus being what I think of as a holistic healer.

The difference is that a holistic healer is really somebody, and again, I’m just making my definitions and distinctions, you can argue the words and create your own words if you like, but my point is that there are many people, chiropractors, massage therapists and so on, nutritionists, that use non-pharmaceutical approaches to treat symptoms. Essentially that becomes their goal. Their explanation is, “Look, you can either heal your symptom through pharmaceutical means or surgery or you can use non-pharmaceutical methods and approaches.” I don’t say that that’s wrong or bad or anything, I think it’s wonderful, but wellness is really something different. Wellness by our definition, again people can argue that wellness is early detection of disease and that’s what they confuse it for often times, but what we’re trying to teach is that wellness is really about teaching people to take self-responsibility. It’s about helping people do the things for themselves that they’re capable of.

We often times use the metaphor of money. Most people don’t consider themselves wealthy because they’re not bankrupt and yet that’s the way most people define being healthy. Most people think they’re healthy because they’re not diseased, sick or injured. It’s completely inaccurate and it’s time for us to use terms that really are more reflective and accurate in what it is that we’re trying to accomplish. Health and wealth are in essence the same. Wealth is something that most people seek to attain. They work hard to attain it and it’s something that is constantly evolving and goring. If I give you 200 dollars you’d probably want 400. If I give you 1,000 dollars you’d probably want 2,000. There’s more. And health really is the same thing. There’s more to it. It is something you can build, it is something you can grow. You can be healthier at 40 than you could be at 30 and so on and so forth, depending on your self-responsibility and what you do. That’s really the education we try to, again, inspire more than inform, inspire people to learn and really take part in.

So that’s the first secret. The wellness industry must adapt to the changing environment that is taking place by focusing on really inspiring people to want to improve their health, not just to use us as a drugless solution to just simply fixing a problem that they’re going to go back and end up probably recreating because of their lifestyle anyway.

Four Tips To Build Your Own Successful MLM Opt-In List

If you currently are operating a MLM business from home you already know how important it is to have a continuous flow of highly targeted prospects. You also know that to help your business grow, some of your prospects need to join your MLM home-based opportunity.

While most MLM companies have a way for their distributors to keep in touch with their prospects with tools such as an autoresponder, in reality, much more is needed. Distributors in MLM opportunities need to be able to create their own opt-in lists through other creative strategies; they need to have a way to stand out from the crowded field of distributors that is so unique people will want to sign up and receive more information from them by subscribing to their list.

The good news is there is a way to do this. Here are four tips to help you build in your own, highly responsive and targeted MLM opt-in list.

Tip #1: Research your competitor’s websites. Look at how they market their items. Study if they have a clean web page; look to see if they are missing something in their message and how your approach can be different. Doing this will give you ideas about what you can do better when building your own list of opt-in subscribers.

Tip #2: Visit forums. Go to Google and type in whatever product your MLM company promotes along with the word forum. When you find a forum, lurk around quietly and see what people are saying about your product. Listen and see if there is are additional problems or concerns that the other websites you visited have not solved. This gives you the perfect opportunity to solve whatever the issues and be viewed as an expert. Most people would be willing to opt-in to your list if they realize you have something of value to offer.

Tip #3: Set up Joint Ventures. Research who else is selling your company’s product or something similar (e.g. health club). Look at other sites as well that may not be in direct competition, but who have products or services that could be of interest to your prospects. For example, maybe your product is a health juice, and your local chiropractor sends out a monthly newsletter to his customers. You could ask your chiropractor if he would be willing to let you write an article to include in his newsletter (with your signature file at the end of course!). In return, you could promote the benefits of chiropractic medicine to your customers along with a recommendation for your local prospects to visit the chiropractor and receive a 50% discount off the first office visit. The chiropractor, of course, would need to be willing to take 50% off the first visit. This would be a win-win situation for both of you. You would get more exposure for your business and your chiropractor more patients.

Tips#3: Create your own unique lead capture or splash page. This page should have the solutions to the problems your research showed people have as well as a link to your site to click for more information.

Tip#4: Create a newsletter. You could use your lead capture page as a means for people to sign up for your newsletter. Your newsletter should have good quality content and provide useful information to your subscribers. It should be sent out at least once a month and can include any other back-end offers or products that you promote which might be of potential interest to your list. Of course, links on how people can sign up or get the products of your MLM company would also be included as well!

These are simple tips that you can use to create your own unique opt-in MLM list of prospects on an on-going basis. They will help you stand out from the field of distributors of your company, and help your business to continue to grow.

How To Setup A Google Adwords Account

To setup a campaign, go to www.adwords.google.com. When asked between a starter and standard edition, choose standard. After choosing your language, you will be asked to choose how you will target customers by location. This is very important.

Be sure to choose the “customized” selection. This allows you to select a radius around your practice that your ads will show up on. This ensures someone from 500 miles away isn’t clicking your ad and running up your bill with Google. You can decide how far to go from your practice, but I recommend 15-30 mile radius depending on if you practice in the city or a small town.

You’ll then be asked to setup your first ad. You only get 25-35 characters for four lines of text, two of which are your headline and website address. Here’s the proven formula for your ads:

• First line should contain your keyword in a headline type phrase

• Second line should be a benefit you offer, for example “Get Rid Of Migraines” •Line three should describe a feature offer, like “Without Drugs Or Surgery”

• Line four is your URL, with each word capitalized and using a keyword in your landing page address if possible

The next step is choosing your keywords. These are the words that your ad will show for when people type them into the search engine. For now just choose the keyword “chiropractor yourtown” (replace yourtown with your actually town you practice in, like “chiropractor Dallas, TX).

Choose your daily budget. Be sure to set a daily budget that you are comfortable with, like $10-20 per day for now. Once your daily budget is reached, your ad stops running.

If set too low, your ad might stop running in the most important part of the day. In the last step, you will be asked to set your maximum cost-per-click. This is the most you will bid on your keywords.

The maximum cost per click will apply to all the keywords you chose earlier. I can’t tell you exactly what to bid on your keywords, as it will be different depending on where you practice and the keywords you choose. But I will show you how to determine what you should bid and how to get lower bids. Now your campaign is ready to go.

What keywords should you use? Choose keywords that you feel are important to your practice. What type of conditions or niches do you want to bring in to your practice? Bid on those keywords.

Keyword Matching One thing about keywords that may interest you is the different types of matching you can use with Adwords. The three types of keyword matching are broad, phrase and exact. You should also use negative matching to exclude those search terms that don’t apply to your Adwords campaign. Here is how Google describes their keyword matching…

• Broader matching options tend to give you more impressions but accrue higher costs. Therefore, include other matching options (like phrase- or exact-match) along with broad-matched keywords in an ad group.

• Broad-matched keywords should be at least two-word phrases (gourmet coffee or organic coffee beans).

• Narrower matching options tend to give you fewer clicks and lower your costs. It’s still important to use descriptive words for these matching options.

• Negative keywords work well in most cases when you know a term doesn’t apply to your business.

To use broad matching, you simply enter in the term by itself. Let’s use the word chiropractic for example. Here’s how the broad, phrase and exact match would work for the search term chiropractic

Broad match = chiropractic (any search typing which includes chiropractic will show your ad, including searches like chiropractic marketing, chiropractic tables, etc)

Phrase Match = “chiropractic Dallas, TX” (Enter this with quotes around it into your Adwords account. Any search that includes this phrase exactly will show your ad, including for example “chiropractic Dallas, TX clinics”, “advanced chiropractic Dallas, TX”, etc

Exact Match = [chiropractic Dallas, TX] (This match is entered into your Adwords account with brackets around it. This means for your ad to show up, someone will have to type this phrase in exactly like you input it, so your ad will only show for the search chiropractic Dallas, TX.)

Negative keywords = a word with a negative sign in the front of it, like “-tables”, without the quotes. When combined with the above broad and phrase match this will prevent your ad showing when someone types in “chiropractic tables”.

Which of the above match types should you use? All of them have their place. If you have a lot of competition for Adwords bid prices in your area, then the phrase and exact matches will allow you to beat out your competition and you will pay less for bids on keywords
